The processing of personal data by Terra Raíz complies with Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data.

• Within the scope of this policy, Terra Raíz undertakes to:
• Explain the purpose and manner of processing any personal data requested;
• Use personal data only for the purpose mentioned in this policy;
• Request only the necessary personal data, taking the necessary steps to keep the data up to date;
• Keep personal data for the period of time necessary for its processing in accordance with local legislation;
• Provide customers/candidates looking for a job with the means to access, change, correct or delete their personal data;
• Keep personal data received confidential and protected, unless disclosure is required as a result of a legal order.
• Implement a culture of data minimization, in which only personal data strictly necessary for carrying out your activity are collected, used and preserved.
• Adopt the necessary security measures to guarantee the safeguarding of users' personal data against possible abusive use or against unauthorized access.

What is personal data?
Any information, of any nature and regardless of its support, including sound and image, relating to an identified or identifiable natural person (data subject).
An identifiable person is a person who can be identified, directly or indirectly, namely by reference to an identification number or to one or more specific elements of their physical, physiological, psychological, economic, cultural or social identity;

Scope
Terra Raíz's Privacy Policy applies in the following cases:

• The Terra Raíz site.

1. Collection and Processing of Personal Data

As an Accommodation customer, your personal data and/or the personal data of your family members may be requested for different purposes, namely:

Contacts: name, nationality, telephone number, email, address, etc.;
Date of birth;
Credit card details;
Arrival Departure Dates;
Information about children: name, date of birth, age (as part of the price reduction policy);
Interests and preferences: such as preferred room location, room type preference and requested bed, rollaway beds, etc.;
Possible customer comments during or after the stay.
As a job candidate or intern at Terra Raíz, the following personal data may be requested:

All necessary data arising from the formalization of the employment contract.
We do not solicit sensitive information such as: religious or philosophical beliefs, political opinions, information about health, race or ethnicity, sexual orientation or union membership.

Personal data may be requested in different circumstances, including (but not limited to) the following:

Participation in advertising programs (subscription to newsletters to receive offers/promotions, registration in loyalty programs; collaboration in surveys and/or customer comments, competitions);
Terra Raíz activities (eg reservation of rooms or tables, check-in and check-out; complaints or requests);
Providing information about tour operators, travel agencies or online booking systems;
Internet activities (link to Terra Raíz website; filling in forms to request data online - for example, online reservations, questionnaires, etc.);
Job or internship applications.

2. Purposes of Requesting Personal Data.

Personal data are requested for the following purposes:
Management of customer reservations and stays;
Improvement of the services provided, in order to understand customer needs and exceed their expectations;
Customization of our services;
Sending newsletters, promotions and advertising materials. Customers can unsubscribe to the email newsletter service by clicking on the link to the newsletter we send by email;
Hiring employees.

3. Reservation of rooms on our website at www.terraraiz.pt

1. Terra Raíz uses the Wix booking engine.
2. All data entered will be treated by Wix under the terms established by the RGPD legislation and always with the declared consent of the customers;
3. The Customer must give his consent to the privacy policy when booking rooms; being able at any time to have the right to access the files, rectify them, cancel them or oppose them under the terms established in the RGPD legislation.

4. Sharing of Personal Data

Terra Raíz may share customer/candidate personal data with:

Terra Raíz employees, namely to provide the requested services and/or to manage the client/candidate databases (officially authorized by the Data Protection Officer).
The authorities – if required by local legislation or within the scope of internal inspections at Terra Raíz, in accordance with legal requirements (Sending data to the SEF).
In case of transmission of personal data to third parties (SEF), obligations under applicable laws will be strictly complied with and every effort will be made to ensure that such third parties use personal data properly, in accordance with this Privacy Policy.

 

 

5. Rights of data subjects

Under applicable law, Customers, as data subjects, have the following rights:

• right of access: whenever you request it, you can access your personal data, obtain information related to the processing of your data and also obtain a copy of your personal data which is being processed.
• right of rectification: whenever you consider that your personal data are incomplete or incorrect, you can request their rectification or that they be completed.
• right to deletion: without prejudice to legal and regulatory obligations that may limit the exercise of this right, you can request the deletion of your personal data when one of the following situations occurs:
 

- personal data is no longer necessary for the purpose for which it was collected or processed; 
- withdraw the consent on which the data processing is based and there is no other legal basis for it;
 
- presents opposition to the processing of data and there are no prevailing legitimate interests, to be assessed on a case-by-case basis, that justify the processing;
 
- personal data have to be erased under a legal obligation to which Terra Raíz is subject;
 
-the personal data has been unlawfully processed; or the personal data has been collected in connection with the provision of information society services.
 

The right to erasure does not apply when treatment is necessary

- for the exercise of freedom of expression and information;
- for the fulfillment of a legal obligation that requires the treatment;
- for reasons of public interest in the field of public health;
- for archival purposes of public interest, scientific or historical research or statistical purposes, insofar as the exercise of the right to erasure seriously impairs the achievement of the objectives of such treatment; or for the purpose of asserting, exercising or defending a right in a legal proceeding.

• right to limitation of processing: you may request limitation of the processing of your personal data in the following cases: (i) if you dispute the accuracy of your personal data, for a period of time that allows verification of their accuracy; (ii) if the processing is illegal and opposes the deletion of the data, requesting, in return, the limitation of its use; (iii) if Terra Raíz no longer needs the personal data for processing purposes, but if such data are necessary for the purpose of asserting, exercising or defending a right in a legal proceeding; or (iv) if you have filed opposition to the treatment, until it is verified that Terra Raíz's legitimate interests prevail over yours.
• right to withdraw your consent: in cases where data is processed based on your consent, you can withdraw consent at any time. In this case, your personal data will no longer be processed, unless there is another reason that justifies such treatment by Terra Raíz.
• right to file complaints with the CNPD: you have the right to file complaints regarding matters related to the processing of your personal data with the National Data Protection Commission.

Terra Raíz implemented the necessary technical and organizational measures, in accordance with legal requirements, in order to protect the personal data of customers and job seekers, ensuring confidentiality in accordance with the rules established in this policy.

Whenever credit card information is requested, this communication is made through Terra Raíz SSL (Secured Sockets Layer) security lines, provided that a browser that allows SSL is used, such as Microsoft Internet Explorer or Google Chrome.
